1. Acceptance of Terms
By accessing and using Nyx Virtual Solution's services, you accept and agree to be bound by the terms and conditions set forth in this agreement. If you do not agree to these terms, please do not use our services.
2. Description of Service
Nyx Virtual Solution is a small creative team that provides professional design, development, and marketing services through a ticket-based subscription system. Services include but are not limited to:
- Website development and design
- Sales funnel creation
- Business automation
- Graphic design
- Email marketing campaigns
- Content writing
- SEO services
- Social media management
3. Ticket System
How it works:
- Each task requires a certain number of tickets based on priority level (1-4 tickets)
- Tickets are deducted when tasks are submitted
- Ticket rollover depends on your subscription plan (SCALE: 60 days, DOMINATE: 90 days, both require active subscription)
- LAUNCH plan tickets expire at month-end
Refund Policy: We do not offer refunds for unused tickets or completed tasks. Our team works hard to deliver quality work. However, we will make revisions until you are satisfied with the results.
4. Subscription Plans and Billing
Subscription Terms:
- All subscriptions are billed monthly
- No contracts - cancel anytime
- Full payment is required at the start of each billing cycle
- No prorated charges for mid-month plan changes
- When upgrading, full payment is required and subscription dates are updated
- When downgrading, changes take effect at the next billing cycle
- All payments are processed securely through PayPal
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for the current month.
5. Task Delivery Times
Delivery times are based on the priority level selected:
- Low priority: 1-14 business days
- Medium priority: 1-7 business days
- High priority: 1-5 business days
- Urgent priority: 1-3 business days
Times are in business days (Monday-Friday). We operate Monday-Friday and do not work on weekends or holidays.
6. Client Responsibilities
You agree to:
- Provide accurate, complete, and current information
- Provide clear instructions and requirements for tasks
- Respond to requests for clarification promptly
- Review completed work and request revisions if needed
- Use the service in compliance with all applicable laws
- Not submit any illegal, offensive, or harmful content
- Maintain the security of your account credentials
7. Revisions and Changes
Minor revisions are included with your initial task submission at no additional cost. Major scope changes or additional requirements not included in the original task may require additional tickets.
8. Intellectual Property
Work Ownership: Upon completion and full payment, you own all rights to the deliverables created for your tasks. We retain the right to use completed work for portfolio and marketing purposes unless otherwise specified.
Client Materials: You retain all rights to materials you provide to us. By submitting materials, you grant us the right to use them solely for the purpose of completing your tasks.
9. Limitation of Liability
To the maximum extent permitted by law, Nyx Virtual Solution shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services.
10. No Refund Policy
We do not offer refunds for:
- Subscription fees
- Used or unused tickets
- Completed tasks
- Completed revisions
However, we are committed to your satisfaction and will work with you to make revisions until you are happy with the results.
11. Communication and Notifications
You will receive notifications via:
- SMS (for urgent updates and task status changes)
- In-app notifications
By providing your phone number, you consent to receive SMS messages from us. Message and data rates may apply. You may opt-out by replying STOP to any message.
12. Termination
Either party may terminate this agreement at any time. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent or harmful activity.
13. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes via email or website notification. Continued use of our services after changes constitutes acceptance of the new terms.
